Kel’s Klass (“I”, “me”, “my”) provides visitors to Kel’s
Klass blog (my blog) or Kel’s Klass Teacher Pay Teacher Store (TPT Store),
access to the content, subject to the following Terms of Use, which may be
updated by me from time to time without notice to you. By browsing through my
blog, or purchasing items from my Teacher Pay Teacher (TPT) Store, you
acknowledge that you have read, understood, and agree to be legally bound by
these Terms of Use, my PrivacyPolicy, and ExternalSites Disclosure and Service and Product Disclosure information. If you
do not agree to any of these terms, then please do not use the information on Kel’s
Klass blog or products from Kel’s Klass TPT Store.
Any user, who wishes to purchase a product or service
through my TPT Store or through personal consultation, is agreeing to the terms
of this agreement and the Terms and Conditions of Purchase that is directly related
to that product or service. In the event of any conflict between the terms of
this agreement and the Terms and Conditions of Purchase, the Terms and
Conditions of Purchase that goes with the product will be the standard.
Community Guidelines
Kel’s Klass’s community, like any classroom or other
community functions best when its users follow a few simple rules. By
accessing the Kel’s Klass blog or TPT Store, you agree to abide by these
community guidelines and comply with all applicable laws in your use of Kel’s
Klass blog and TPT Store and will not use them for any unlawful purpose;
- You will
not upload, post, email, transmit, or otherwise make available any content
that:
- infringes
any copyright, trademark, right of publicity, or other proprietary rights of
any person or entity; or
- is
defamatory, libelous, indecent, obscene, pornographic, sexually explicit,
invasive of another’s privacy, promotes violence, or contains hate speech
(i.e., speech that attacks or demeans a group based on race or ethnic origin,
religion, disability, gender, age, veteran status, and/or sexual
orientation/gender identity; or
- discloses
any sensitive information about another person, including that person’s email
address, postal address, phone number, credit card information, or any similar
information.
- You will
not “stalk,” threaten, or otherwise harass another person;
- You will
not spam or use Kel’s Klass to engage in any commercial activities;
- You will
not access or use Kel’s Klass blog or TPT Store to collect any market research
for a competing business;
- You will
not impersonate any person or entity or falsely state or otherwise misrepresent
your affiliation with a person or entity;
- You will
not interfere with or attempt to interrupt the proper operation of Kel’s Klass
blog or TPT Store through the use of any virus, device, information collection
or transmission mechanism, software or routine, or access or attempt to gain
access to any data, files, or passwords related to Kel’s Klass blog or TPT
Store through hacking, password or data mining, or any other means;
- You will
not cover, obscure, block, or in any way interfere with any advertisements
and/or safety features (e.g., report abuse button) on my blog or TPT Store;
- You will
not use any robot, spider, scraper, or other automated means to access my blog
or TPT Store for any purpose without my written permission; provided, however, I
grant the operators of public search engines permission to use spiders to copy
materials from the public portions of my blog or TPT Store for the sole purpose
of and solely to the extent necessary for creating publicly-available
searchable indices of the materials, but not caches or archives of such
materials;
- You will
not take any action that imposes or may impose (in my sole discretion) an
unreasonable or disproportionately large load on our technical infrastructure;
and
- You will
let me know about inappropriate content of which you become aware. If you find
something that violates our Community Guidelines, please let me know, and I
will review it.
Comments are welcome. I moderate them to prevent the spread
of spam and hate and anything I deem inappropriate for an educational site. If
I object to something you commented on because it has swear words or is
inappropriate, I would respond to you, so you can edit yourself if you like.
If your comment disagrees with me, that is fine, but please
be cordial and/or professional. This is my site where I share my views and
allow others to share theirs within reason. Comments need to relate to what we
are talking about. I reserve the right to deny you access to the Kel’s Klass
blog or TPT Store, without notice, and to remove any content that does not
adhere to these Community Guidelines.
Age Restrictions
Kel’s Klass is only available for individuals aged 13 years
or older. If you are not 13 years or older, you should review this agreement
with your parent or guardian to make sure that you and your parent or guardian
understand it. You must be 13 years of age or older to sign up for any
email communication or my blog activity participation. I do not intentionally
or knowingly collect Personal Data from anyone under the age of 13. If you are
a parent or guardian of a child under 13 and believe they disclosed Personal
Data to me, you may contact me immediately at kelsklass {at} gmail {dot} com.

Intellectual Property
Kel’s Klass contains material, which could include items such
as videos, coursework, lesson plans, training modules, photographs, software,
text, graphics, images, sound recordings, and other material provided by Kel’s
Klass or myself, Kelly Brown. These items may be owned by third parties or me. They
are protected under both United States and foreign laws. Unauthorized use of the
items may violate copyright, trademark, and other laws.
Visitors may view all publicly available items for their own
personal, non-commercial use. Kel’s Klass TPT Store customers, who have
purchased any product or service, may download onto their own machines and view
or use any items contained in their purchased product or service for their own
personal, non-commercial use. Kel’s Klass retains all intellectual property
rights of the content and information provided. You may not sell, transfer,
assign, license, sublicense, or modify any purchased products or reproduce,
display, publicly perform, make a different version of, distribute, or
otherwise use the Kel’s Klass blog items or Kel’s Klass TPT Store purchases in
any way for any public or commercial purpose. I am happy to work with you if
you want to use any items provided for another purpose, where credit is given
to Kel’s Klass when advertised or shared. None of the items or content shared
under the name of Kel’s Klass may be retransmitted without my written consent
for each and every instance.
Other company, product, and service names located on Kel’s
Klass blog may be trademarks or service marks owned by other third-party
vendors.

No Warranties; Limitations of Liability
The Kel’s Klass blog or Kel’s Klass TPT Store may contain
technical inaccuracies, typographical errors, or omissions. I reserve the right
to make changes, corrections, and/or improvements to the content at any time,
without given notice. If you find a typographical error, please feel free to
contact me at kelsklass {at} gmail {dot} come and I will fix errors in a timely
manner and repost products for use.
Compliance with Applicable Laws
Kel’s Klass blog and Kel’s Klass TPT Store are based in The United States. I make no claims concerning whether content and information may
be downloaded, viewed, or be appropriate for use outside of the United States.
If you access Kel’s Klass or any information and product from outside of The United States, you do so at your own risk.
The laws of the State of Indiana will govern this agreement
and any action related to it.
Digital Millennium Copyright Act
Kel’s Klass respects the intellectual property rights of
others and attempts to comply with all relevant laws. I will review all claims
of copyright infringement received and remove any content, information, or products
deemed to have been posted or distributed in violation of any such laws.
